New England Beasts Player Waiver Form

THIS IS A RELEASE OF LIABILITY & WAIVER OF CERTAIN LEGAL RIGHTS.

1. The person who is participating in the Activity (defined below) is referred to as “Participant.” I am the Participant’s parent or legal guardian and am entering into this waiver on behalf of the Participant. I understand that participating in any New England Beasts, games or events (including participating in any activities related thereto including, without limitation, practicing and playing the game of softball (collectively, the “Activity”), can be HAZARDOUS AND INVOLVE THE RISK OF PHYSICAL INJURY AND/OR EVEN DEATH.

2. I understand the dangers and risks of the Activity and the Participant ASSUMES ALL INHERENT DANGERS AND RISKS of the Activity. I understand that participation in field hockey, basketball and/or softball may result in serious injuries and protective equipment does not prevent all injuries to players.

3. THE PARTICIPANT AND THE PARTICIPANT'S PARENT OR LEGAL GUARDIAN HEREBY RELEASES, WAIVES AND DISCHARGES New England Beasts and its directors, officers, personnel, managers, members, coaches, volunteers, employees, representatives and agents (hereinafter referred to as “Releasees”) from any and all liability to the Participant, his or her personal representatives, assigns, heirs, and next of kin, for any loss or damage, and any claim or demands therefore on account of injury to the person or property or resulting in the death of the Participant, whether caused by the negligence of the Releasees or otherwise, as a result of the Participant’s attendance/participation in the Activity. THE PARTICIPANT HEREBY COVENANTS NOT TO SUE ANY OF THE RELEASEES FOR ANY REASON OR MATTER IN CONNECTION WITH THE PARTICIPANTS PARTICIPATION IN THE ACTIVITY.

4. THE PARTICIPANT further expressly agrees that the foregoing release, waiver and indemnity is intended to be as broad and inclusive as is permitted by applicable law and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect

5. I represent that Participant is in good health and that there are no special problems associated with Participant’s physical or mental condition. I authorize a licensed physician or other medical care provider to carry out any emergency medical care for Participant which may be necessary and agree to be fully responsible for any costs associated with such care or transport to such care.

6. I grant the Releasees the right of publicity to own, display and use any image collected of Participant while participating in the Activity (including, but not limited to, any images, photographs or videos).

7. I agree that any and all claims for loss, injury and/or death arising from the Participant’s participation in the Activity shall be governed by the law of the Commonwealth of Massachusetts and that exclusive jurisdiction of any such claim shall be the state or federal court in the Commonwealth of Massachusetts.

8. I REPRESENT THAT I AM THE LEGAL PARENT OR GUARDIAN OF THE PARTICIPANT and acknowledge that the Participant is bound by all the terms of this Waiver. I understand that the minor Participant would not be permitted to take part in any of the Activities unless I agree to the terms of this Waiver. By agreeing to this Waiver without a parent or legal guardian’s signature, I represent, under penalty of fraud, that I am at least 18 years old.

9. I AGREE TO INDEMNIFY THE RELEASED PARTIES FOR ALL LIABILITY AND CLAIMS, INCLUDING ATTORNEYS’ FEES, ARISING FROM ANY MISREPRESENTATIONS OR FRAUD IN CONNECTION WITH THIS WAIVER.
